Conditions of Cooperation
FORM OF
COOPERATION IN BOOKING OF STAYS:
The
Partner (owner of the accommodation facility) can choose one of the following
systems of reservation:
1. ONLINE reservation:
At this system of cooperation the Partner is obliged to update the
Occupation table on www.limba.com/private (using his login and
password).
If the accommodation facility is fully available for required dates according
the Occupation table and the stay begins later than in 7 days, the Limba TA
confirms the reservation to the customer immediately – without contacting the
Partner.
If just a part of the capacity of the accommodation facility is available
for required dates (family pensions, hotels, bungalows), the Limba TA contacts
the Partner to verify the availability of required rooms/apartments.
The Partner is allowed to occupy the available capacity in occupation table for
his own customers.
At this system of cooperation the coefficient of price
increase of the Partner’s prices is:
Cottages, apartments and family pensions: 1.19 (for example: facility
owner's price 100 x 1,19 = 119 Limba's price for the client)
Hotels and bungalows: 1.17 (for example: facility owner's price 100 x 1,17 =
117 Limba's price for the client)
2. ONLINE reservation + BEST PRICE GUARANTEED:
In addition to the
obligations and the rights resulting from the ONLINE cooperation system,
the Partner cooperating
by the system BEST PRICE GUARANTEED commits to
guarantee, that the client
would pay to Limba TA no higher (equal) price for the accommodation than he
would pay if he ordered the stay directly from the Partner or from another intermediary.
This is achieved by the Partner providing a discount from his rack rates for the
Limba TA. So if the Partner wants to offer his accommodation directly to his
clients for the price of 10 Euro/person/night, he gives the price of 10
Euro/person/night to the Limba TA as well. The Limba TA will sell the
accommodation to the client for 10 Euro and the Partner will get 9,10 Euro. Entering
these prices is very simple – the Partner just enters his rack rates and the discounted price
will be calculated in the Price list automatically.
At this system of cooperation the discount from the Partner’s prices is 9%.
3. Reservation “On request“
At this system of cooperation the Limba TA always contacts the Partner to
verify the availability of the accommodation capacity of the Partner.
The Limba TA motivates the Partners to report the
occupied dates. In case the Partner refuses a reservation of the Limba TA,
the Limba TA will increase the coefficient of price increase of the Partner’s
prices by one percent. In case the Partner confirms the possibility of
reservation, after the first payment is made by the customer, the Limba TA will
reduce the coefficient of price increase of the Partner’s prices by one
percent.
At this system of cooperation the coefficient of price increase
of the Partner’s prices is:
Cottages, apartments and family pensions: the initial coefficient of
price increase of the Partner’s prices is 1.25, and the increase and the
decrease of the coefficient is limited to range 1.22 – 1.5.
Hotels and bungalows: the initial coefficient of price increase of the
Partner’s prices is 1.22, and the increase and the decrease of the coefficient
is limited to range 1.19 – 1.5.
In
each system of reservation the Partner is obliged to confirm the Binding Order
without delay.
PRICES:
The Partner can change the prices anytime via the Internet
(on the website www.limba.com/private using his login and
password). The change of the price will not effect
stays which customers have already made the first payments on, or orders which
are already in progress. If the Partner does not report the new prices, the
prices for the given period of the previous year indicated in the price list of
the Limba TA will stay in effect automatically. In the price calculation
of small stays the Limba TA reflects the number of persons and the
number of nights to ensure the profitability of the reservations. The Limba TA requires at least 15%
reduction of the rack rates for the accommodation in hotels (the Limba TA's
price for the customer is approximately at rack rates at the discount
of 20%).
PAYMENT FOR THE STAY:
The
payment for the stay will proceed so that the Limba TA will receive the first
payment from the customer including the commission of
the Limba TA and approximately 50% of the Partner’s total price, whereas the
second amount will be transferred by the Limba TA to the Partner’s account as
the first payment upon receiving the confirmed Binding Order without delay. The
additional fee, approximately 50%, will be paid by the customer upon arrival.
CANCELLATION:
In
case of cancellation of the Binding Order by the customer the Partner always
has the right for compensation in a form of a cancellation fee, which
specifies as follows:
* In case of cancellation of the
Binding Order by the customer more than 60 days before the stay the
cancellation fee is 10% from the Partner’s total price for the accommodation
(not for the catering). At most in the amount of the received
first payment.
* In case of cancellation of the
Binding Order by the customer 60 to 30 days before the stay the cancellation
fee is 25% from the Partner’s total price for the accommodation (not for the
catering). At most in the amount of the received first
payment.
* In case of cancellation of the
Binding Order by the customer 30 to 10 days before the stay the cancellation
fee is 35% from the Partner’s total price for the accommodation (not for the
catering). At most in the amount of the received first
payment.
* In case of cancellation of the
Binding Order by the customer less than 10 days before the stay the
cancellation fee is 50% from the Partner’s total price for the accommodation
(not for the catering). At most in the amount of the received
first payment.
If
the first payment sent to the Partner by the Limba TA was higher than the
cancellation fee, the Partner is is obliged to return
the rest of the first payment after subtraction of the cancellation fee to the
Limba TA within 7 days at the latest from the
notification of the cancellation of the stay.
CANCELLATION OF THE STAY BY THE
PARTNER:
In
case of not confirming or cancelling the Binding Order by the Partner, the
Partner is obliged to return the received first payment for the accommodation
together with the contractual penalty to the Limba TA within 7 days from the
cancellation. If the first payment has not yet been sent to the Partner, the
obligation concerns only the contractual penalty.
The
amount of the contractual penalty depends on the date of the cancellation. If
the Partner does not confirm or cancel the order more
than 30 days before the arrival, the contractual penalty is determined in the
amount of 50% of the Partner’s total price for the stay. In case of not
confirmation or cancellation of the order 30 or less than 30 days before the
arrival, the contractual penalty is determined in the amount of the Partner’s
total price for the stay.
The
obligation of the Partner for paying the contractual penalty does not concern
cases when it is necessary to cancel the stay due to a "superior force”
(natural disaster, epidemic, war, government upheaval, etc.). The Partner is
obliged to do his best to minimize the damages and the loss in case of cancellation
due to "superior force”.
CHECK IN AND CHECK OUT OF THE
CUSTOMERS:
The
customers can check in from 2 PM on the day of the arrival. On the day of the
departure the customers will vacate the rooms by 10 AM. The Partner checks the
state of his accommodation facility at the departure of the customers, and in
case of discovering any damages he solves its compensation with the customer on the spot.
QUALITY OF THE ACCOMMODATION:
The
Partner is obliged to accommodate customers mediated via the Limba TA exactly
in accordance to all information about the accommodation on the website.
The
Partner is obliged to inform the Limba TA in time of all changes and
circumstances which can have an effect on the range and the quality of the
provided services.
The
Partner is obliged to maintain the accommodation facility in an operative
state, keep it clean, and create conditions for the satisfaction of the mediated customers. All indicated equipment
operates and is undamaged.
If
not specified elsewhere in the description about the object, all equipment and services are included in the price for
the accommodation (i.e. fee for the sauna, bicycle rental, etc.).
The
Partner is obliged to accommodate the customers paying the minimum capacity of
the accommodation facility so that they will have the entire accommodation facility for themselves (all indicated
premises and rooms), whereas there cannot be accommodated any other persons in
the premises of the accommodation facility (the owner or other tourists). The
Partner prepares bedclothes for the number of persons indicated in the order.
The
rules specified in this document are appended by rules relating to
a particular stay recorded in the Binding Order. The customer has
a right to make a complaint in case of breaking these rules.
The
accommodation owner should take care of the final cleanup. The accommodation
owner can not ask the client to leave the accommodation facility tidy at the
end of the stay.
COMPLAINT:
The
Partner verifies the customer’s complaint and takes care of
the compensation of the customer, as well as making corrections and
precautions for the future in case of a valid complaint.
The
Partner is fully responsible for the financial loss occurring to the Limba TA
due to a breach of duty of the Partner.
DURATION OF THE COOPERATION:
Either
of the cooperating parties is entitled to end the cooperation at any time,
however, he must notify the other party in writing. In case of ending the
cooperation, the commitments of both parties
concerning the agreed stays continue.
SOLVING CONFLICTS:
The
contracting parties have agreed that all conflicts which can occur from this
agreement, including conflicts about its validity, interpretation, or
cancellation, will be solved at the Tribunal of the Slovak Commercial and
Industrial Association in
REGISTRATION FEE:
One-time registration fee of 19 Euro is required for
publishing your accommodation facility on the Limba TA web site. You can
